Limited time Coupon. Expired?
I own a dry cleaners. For 4 years we had a low price coupon that says "Limited time". We did not have an expiration date on it since we knew we were going to honor them for a long time. After 4 years, we are unable to keep honoring the coupon since all of our supplies went up. I posted a sign that says " After 4 years, the $.99 Cent coupon has expired. The limited time was over on September 2008, For our customer’s who still have these coupons, we will honor them at the new price of $1.49 per piece, Thank you". Our regular price is $2.25 a garment so our customers are still getting an unbeatable discount. We are the most economical dry cleaners in the area. About 95% of our customers understand the reason why we are not taking the $.99 cent coupon but I received a letter from an attorney from 1 customer who is complaining that not taking the coupon is illegal. ALso, the coupon that the customer’s are bringing are old, they saved them since we had them at the supermarkets for 4 years, we stopped them in May of this year. The new coupons have a price of $1.69 per piece, we are no longer running any $.99 cent or $1.49, but we will accept the $1.49 instead of the $.99 cent. Can anyone help me? Am I safe by posting the sign or is there anything else I should be doing?
Since this is your business and someone has been rotten enough to get a lawyer involved, you should probably pay a consultation fee to your own attorney for advice on this matter.

The posted sign says it all. In this day and age only someone pretty stupid would think a coupon saved from years ago is still valid, even without a due date on it. Your sign invalidates the coupon so you’re covered.
If the case should be brought up in front of a judge he’d find in your favor, don’t worry. The lawyer may just be a family member thinking it didn’t hurt to just send a letter. I’m sure he knows this economy doesn’t let ANYONE honor a coupon till infinity. Nobody does that. Your sign should be enough.
You can send a calmly worded letter BACK to the attorney with the new information, plus noting that the coupon is not rejected outright, it’s been adjusted for inflation. Also note in the letter the last time the coupons were actually printed. Anything being honored longer than 4 years past is really just a perk that the store is offering. Common sense says a coupon can be discontinued with no advance warning, for whatever reason. It’s only a perk, not a contract.
Geez, with today’s economy even $1.69 is a bargain.

Well I hope the customer IS the lawyer, because I don’t know what to make of a person who spends five hundred dollars to contest fifty cents.
They wouldn’t dare file a claim against you; they’d be thrown out for wasting the court’s time. Ignore the letter. Or maybe post it for a laugh.
In your position, I would honor the coupons (only if someone complains) until November, which is six months after you stopped distributing them and is a more than reasonable time-frame for someone to redeem it.

Do not honor the coupon, once you do you will open yourself up to trouble– if you accept this one coupon you void your own sign. After 4 years you do not even need a sign, coupons are NOT contracts you can stop accepting a coupon any time you like even before the date stated on the coupon. Just tell the customer you are no longer accepting them, also call the "lawyer" who sent you the letter and if you need to contact your local DA’s office if he really is a lawyer, he just lied and tried to intimidate you and he could get in to real trouble if the letter was sent of official letterhead.
